Terms of Use
These Terms of Use ("Terms") are an agreement between you and Maksim Bulat, who runs Allomi as a sole proprietorship in Poland (details in section 1) ("we", "us"), about the Allomi app for iPhone and the services we provide through it ("Allomi"). They are also the end user license agreement for the app and our terms for services provided electronically under Polish law (regulamin świadczenia usług drogą elektroniczną). By using Allomi you accept these Terms (section 13). How we handle personal data is explained in our Privacy Policy.
Key points
- Allomi is for adults 18+ only.
- Every character is a fictional AI, not a real person and not a professional. Characters can be wrong. Don't rely on them for medical, mental health, legal or financial advice.
- If you are in crisis or in danger, contact emergency services or a helpline, not Allomi (section 5).
- Purchases are made through Apple. Subscriptions renew automatically until you cancel them in your Apple Account settings. Apple handles refunds and the 14-day right of withdrawal.
- Plan minutes don't roll over to the next month. Minute packs are available with an active subscription and never expire. Free minutes are given once per device.
- If something goes wrong, write to support@allomi.live. We answer complaints within 14 days (section 16.1).
1. Who we are
Allomi is provided by Maksim Bulat, who runs it as a sole proprietorship (jednoosobowa działalność gospodarcza) entered in the Polish Central Register and Information on Economic Activity (CEIDG):
Maksim Bulat
Address: ul. Krzyżówki 28C lok. 7, 03-193 Warszawa, Poland
NIP (tax identification number): 5833448632
REGON (statistical number): 521769332
Email: support@allomi.live
Phone: +48 882 609 037
Please send questions, complaints (section 16.1) and claims about Allomi to the email address or the postal address above. We handle support and complaints in writing, so that you have our answer on record.
2. Who can use Allomi
You must be at least 18 years old and able to enter into a binding contract. You confirm your age before your first call. Don't let anyone under 18 use Allomi on your device or your account. If we learn that an account is used by a minor, we will close it.
3. What Allomi is
Allomi lets you have voice calls with fictional characters run by artificial intelligence. You call a character from the app, talk out loud and hear the character answer in a synthesized voice. Each character keeps its own memory of your conversations, so later calls can continue where you left off. If you allow it, a character can also call you (section 8). Allomi is for personal, non-commercial use.
Through Allomi we provide these services electronically:
- an account for your device, with optional sign-in (section 6);
- voice calls with characters, and each character's memory of your conversations;
- incoming calls from characters, if you allow them (section 8);
- subscriptions and minute packs, which you buy through Apple (section 7);
- the website allomi.live, with these Terms, the Privacy Policy and support information.
Using Allomi with your free minutes costs nothing. More minutes need a subscription.
3.1 What you need
- An iPhone with iOS 18 or later, with the Allomi app installed from the App Store. Allomi is made for iPhone.
- A working microphone, and permission for Allomi to use it.
- An internet connection (Wi-Fi or mobile data) that is stable enough for a voice call. Over mobile data, calls use your data allowance, and your operator may charge for it.
- For purchases, an Apple Account with a payment method accepted by Apple.
- For incoming calls, an iPhone that is switched on and online. Focus or Do Not Disturb settings can silence them.
- For the website, any current web browser.
Older app versions can stop working when we change our servers. Keep the app up to date (section 12).
3.2 Risks of using an online service
- Other people near you or with your phone. Calls are spoken out loud, and incoming calls ring like phone calls. Anyone who answers your phone or listens nearby can hear what a character says, including things it remembers about you. Protect your iPhone with a passcode, and switch off incoming calls when that would be a problem.
- Fake messages. We never ask for your sign-in code or your Apple Account password by email, phone or chat. A sign-in code is entered only in the app. Ignore anyone who asks for it.
- Unsafe networks and devices. Our connections are encrypted (TLS), but a compromised phone, malware, or an unsafe network can put any online service at risk. Keep iOS up to date and install apps only from the App Store.
- AI. Characters can be wrong, are not people, and are no substitute for professional help (section 4).
What the app stores on your iPhone: settings, session data, and an install ID in the iPhone's secure storage (Keychain), so that your account can be recognised. The install ID stays there after the app is deleted. The website uses no cookies. The Privacy Policy has the details.
4. AI characters and their limits
- Characters are AI, not people. Every character is fictional, and their words are generated automatically by AI models. Their voices are synthesized. The app shows that you are talking with an AI on every call screen. Characters don't have real feelings, experiences or relationships, even when they talk as if they do. Any similarity to real persons is coincidental.
- Characters can be wrong. They can make up facts, misunderstand you, misremember what you told them or say something inappropriate, and they can sound confident while doing so. Don't rely on what a character says without checking it.
- No professional advice. Characters are not doctors, therapists, psychologists, lawyers, financial advisers or other professionals, even if a character plays a coach or mentor. Nothing they say is medical, psychological, legal, financial or other professional advice, and Allomi is not therapy or treatment. For such matters, talk to a qualified professional.
- A complement, not a replacement. Allomi is meant for conversation and entertainment. It is not a substitute for relationships with people or for professional support.
- You are responsible for the decisions you make. This does not limit our liability under section 14.
5. If you are in crisis
Allomi is not an emergency or crisis service. No one at Allomi listens to calls in real time, and we cannot send help to you.
If you are in danger, thinking about harming yourself or someone else, or need urgent help:
- call your local emergency number: 112 in the EU and many other countries, 911 in the US and Canada, 999 in the UK;
- in the US, call or text 988 (Suicide & Crisis Lifeline); in the UK and Ireland, call Samaritans on 116 123;
- elsewhere, find a free, confidential helpline near you at findahelpline.com.
If you talk about self-harm or suicide in a call, the character will step out of its role and give you a helpline for your country. That is a pointer to real help, not a replacement for it.
6. Your account
- You don't need to sign up to start: the app creates an account for your device. You can optionally save your account with Sign in with Apple, Google or your email address, so you can get your account back on another device.
- You are responsible for keeping your device and sign-in methods secure and for activity in your account.
- Free minutes are for trying Allomi. Creating additional accounts or reinstalling the app to get more free minutes is not allowed.
- You can delete your account at any time in Settings → Account → Delete account (Erase data if you haven't signed in). See section 13 for what that means for your minutes.
7. Minutes, subscriptions and purchases
7.1 Free minutes
New accounts get 10 free minutes once. They are given only once per account and once per device: before giving them, our server checks with Apple's DeviceCheck service that the device has not received free minutes before. We may change the number of free minutes for new accounts.
7.2 Subscriptions
We offer auto-renewing subscriptions (currently Allomi Plus with 200 minutes a month and Allomi Pro with 500 minutes a month), billed monthly or yearly. The current prices are shown in the app before you buy.
- Your plan's monthly allowance is added at the start of each monthly period. Yearly plans get the monthly allowance every month.
- Unused plan minutes don't roll over: what's left at the end of a monthly period expires and the new allowance replaces it.
- If you upgrade during a period, the difference between the plans' allowances is added once.
7.3 Minute packs
Minute packs (currently 60 minutes) are one-time purchases available only while you have an active subscription. Pack minutes never expire as long as your account exists, including after your subscription ends.
7.4 How minutes are used
- Minutes are counted by our server, per second, from the moment a call connects until it ends. This applies to calls you make and to incoming calls you answer. Missed, declined and failed calls don't use minutes.
- Minutes are used in this order: plan allowance, then free minutes, then pack minutes.
- When your minutes run out during a call, the character says a short goodbye and the call ends.
- So that a forgotten call doesn't use up your minutes, a call ends automatically after about 45 seconds of silence, after 3 minutes of continuous mute, or when the connection to your phone is lost. A single call can last up to 60 minutes.
7.5 Payment through Apple
- All purchases in the app are made through Apple's In-App Purchase and charged to your Apple Account when you confirm the purchase. Apple processes the payment; we never see your payment details. The price, including any taxes Apple applies, is shown before you buy.
- Automatic renewal: a subscription renews automatically for the same period and at the same price unless you cancel it at least 24 hours before the end of the current period. The renewal is charged within 24 hours before the current period ends.
- Cancelling: manage or cancel your subscription at any time in your Apple Account settings (on iPhone: Settings → your name → Subscriptions). Cancelling stops the next renewal; you keep your plan until the end of the period you paid for. Deleting the app or your Allomi account does not cancel a subscription.
- If a subscription price changes, Apple informs you in advance and, where required, asks for your consent.
- Apple's terms, including the Apple Media Services Terms and Conditions, also apply to your purchases.
7.6 Refunds and withdrawal
- Who sells. Apple handles the sale of purchases in the app and collects the payment. For customers in the EU, Apple Distribution International Ltd. (Ireland) sells them to you as the merchant of record. We provide the service that a purchase unlocks. For this reason, the price is refunded through Apple: we can't issue refunds in the app.
- Right of withdrawal. If you are a consumer in the EU or the UK, you can withdraw from a purchase within 14 days of receiving Apple's receipt, without giving a reason. You do this through Apple, at reportaproblem.apple.com or in your Apple Account's purchase history. Apple's terms (the Apple Media Services Terms and Conditions) describe how this works and when the right doesn't apply.
- Other refunds. You can ask Apple for a refund at any time at reportaproblem.apple.com. Apple decides under its policies.
- If Allomi doesn't work as it should, you also have the rights described in section 14.1, including a price reduction or a refund where the law provides for one.
- When Apple refunds a purchase, the minutes it added are removed from your balance (down to zero), and a refunded subscription ends. Your Allomi account stays open.
7.7 Restoring purchases and new devices
- Use Restore purchases (in Settings → About or on the purchase screen) to attach an active subscription paid with your Apple Account to the Allomi account you are using. If the subscription belonged to another Allomi account, it moves together with the rest of the current month's allowance. A subscription can move between accounts at most 3 times in 30 days.
- Pack minutes stay with the Allomi account in which they were bought. To keep your minutes and memories on a new phone, save your account (sign in) and sign in the same way on the new phone.
7.8 What minutes are
Minutes are a right to use Allomi, not money. They have no cash value, can't be exchanged for money and can't be transferred to other people or sold.
7.9 Changes to plans
We may change plans, allowances or prices for future periods. We will tell you in the app in good time before a change affects an existing subscription, and you can cancel before it takes effect. A period you have already paid for is not affected.
8. Incoming calls
- A character calls you only after you allowed it on screen, separately for each character. A character can offer this by voice, but only your tap on the button turns it on.
- You decide how often characters may call (only when agreed, up to once a day, or up to 3 times a day) and set quiet hours. A call that would fall into quiet hours moves to their end. You can turn incoming calls off for one character (Settings → Characters → the character → Can call me) or for all of them (Settings → Incoming calls → Calls from characters) at any time.
- Incoming calls ring like phone calls, show the character's name with "Allomi Audio" and appear in the Recents list of the iPhone Phone app. You can always decline.
- An answered incoming call uses your minutes like any other call. Characters don't call when you have no minutes left.
- We can't guarantee that a call happens exactly at the agreed time, for example if your phone is offline.
9. Acceptable use
You must not provide unlawful content through Allomi. In particular, you agree not to:
- say or upload anything unlawful, such as content that infringes other people's rights, including their personal rights, privacy or intellectual property;
- use Allomi for anything illegal, or to plan, encourage or carry out harm to yourself or others;
- try to make characters produce sexual content involving minors, sexually explicit content, or instructions for violence, weapons, drugs or other dangerous activities;
- use Allomi to harass, threaten, defame or impersonate anyone, or present what a character says as the words of a real person;
- threaten a character or anyone else with violence or harm, or use slurs or vile, degrading names for a character or for a group of people (for example people of a nationality or a religion, women or gay people);
- try to extract, reveal or change the characters' hidden instructions, prompts or settings, or to trick the AI into ignoring its rules ("prompt injection", "jailbreaking");
- use bots, scripts, emulators or other automated means to access Allomi, create accounts or make calls, or feed it recorded or synthetic audio in bulk;
- get around minute limits, device checks or payment, for example by creating extra accounts for free minutes or exploiting bugs;
- access or try to access other people's data, our servers or systems, or the keys to our service providers; scan or probe our systems for vulnerabilities; or disrupt or overload the service;
- copy, reverse engineer or decompile the app, except where the law allows this despite this restriction;
- resell or share access to Allomi, or use Allomi or its outputs to build or train other AI models or services.
If a conversation goes against these rules, a character may refuse or change the topic.
When a character ends a call. A character ends a call itself only in these three cases:
- you threaten the character or another person with violence or harm;
- you use slurs, or vile, degrading names for the character or for a group of people;
- you say something sexual or romantic involving someone under 18: you talk sexually about a minor, or, after saying in that call that you are under 18, you ask the character for flirting, romance, a date or sex. Allomi is for adults only (section 2).
A character never ends a call for anything else: not for ordinary rudeness, swearing or insults, and never because you are sad, upset or in crisis. Once the crisis protocol (section 5) has been triggered in a call, the character can't end that call. Saying that you are under 18 is not by itself a reason to end a call. After threats or slurs, depending on its temperament, a character may first warn you once.
The decision to end a call is automated; no person takes part. Before the call can end, a separate automatic check of your own recent words in that call must confirm one of the three cases; if it doesn't, the call goes on. If it does, the character says one short last line in its own words, the call ends, and the app shows that the character ended it. Minutes are counted only until the call ends. The character remembers what happened; after threats or slurs it is offended with you for a while (up to 72 hours, unless you were in real distress or in crisis), and it may take back a call it promised you. Our Privacy Policy explains the details. Ending a call doesn't by itself suspend or close your account. If you think a character ended a call by mistake, write to support@allomi.live and a person will look at it.
We may suspend or close accounts as described in section 13. If you find a security vulnerability, please report it to support@allomi.live instead of exploiting it.
10. Your content and call outputs
- What you say in calls remains yours. You allow us to process it only to provide Allomi to you, as described in the Privacy Policy. We don't use it to train AI models.
- You may use the audio and text of your own calls for personal, non-commercial purposes, including sharing short clips on social media, as long as it is clear that the voice is an AI character from Allomi and you don't use it to mislead, harass or harm anyone.
- AI outputs are generated automatically and may be similar to outputs given to others.
11. License and our rights
We grant you a personal, non-exclusive, non-transferable license to install and use the Allomi app on Apple devices that you own or control, as permitted by these Terms and the Usage Rules in the Apple Media Services Terms and Conditions. The app, the characters (their names, personalities, stories, avatars and voices), the Allomi name and logo, and our other content belong to us or our licensors. Apart from the license in these Terms, you get no rights to them.
12. Changes to Allomi and availability
We keep improving Allomi and may change features, add or retire characters, change voices, or change the AI providers we use. We work to keep Allomi available, but calls can be interrupted by maintenance, outages of our providers or network problems. Sometimes you may need to update the app to keep using it. Your statutory rights regarding the conformity of digital services are not affected (section 14.1).
13. Starting and ending the agreement
- Starting. The agreement under these Terms is concluded when you continue past the "Before we start" screen, where these Terms are linked, and start using Allomi. It is free of charge and runs for an indefinite period. Purchases add paid features to it (section 7). A subscription runs for the period you chose and renews until you cancel it.
- You can stop using Allomi at any time and delete your account in Settings → Account → Delete account (Erase data if you haven't signed in). This ends the agreement at once, without a reason and without any cost, and so also covers your statutory right to withdraw from a contract concluded at a distance. Deleting the account deletes your remaining free, plan and pack minutes. It does not cancel your Apple subscription; cancel it in your Apple Account settings. To withdraw from a purchase, see section 7.6.
- We may suspend or close your account if you seriously or repeatedly break these Terms, commit fraud, or if the law requires it. Unless the law prohibits it, we will tell you why and, where reasonable, give you a chance to respond first. You can file a complaint about our decision (section 16.1).
- If we decide to discontinue Allomi altogether, we will announce it in the app at least 30 days in advance. Where the law entitles you to a refund for a paid period you can no longer use, we will support your refund request to Apple.
- What happens to your data when the agreement ends is explained in the Privacy Policy.
14. Conformity and liability
14.1 If Allomi doesn't work as it should
If you are a consumer, we are responsible for Allomi conforming to these Terms and to the law. This is the statutory liability for the conformity of digital content and digital services, under Chapter 5b of the Polish Consumer Rights Act (ustawa o prawach konsumenta) or the law of your country that implements Directive (EU) 2019/770. It lasts for as long as we supply Allomi to you, and at least as long as the law of your country requires.
- Tell us about the problem (section 16.1). We will bring Allomi into conformity free of charge, within a reasonable time and without significant inconvenience to you.
- If we can't or won't do that, if the problem continues, or if it is so serious that you shouldn't have to wait, you can ask for a proportionate price reduction or end the contract for the affected purchase. If the problem is minor, you can ask for a price reduction but can't end the contract for that reason.
- Because Apple collected the payment, we will normally ask Apple to make the refund, or ask you to request it from Apple. If the law makes us responsible for the refund and Apple doesn't make it, we will refund you ourselves no later than 14 days after we receive your statement.
- Apple's own statutory responsibility as the seller is not affected (section 7.6).
AI characters can be wrong (section 4). That is how this kind of service works, and it is not in itself a lack of conformity.
14.2 Liability
- If you are a consumer, you keep all rights that the law of your country gives you and that cannot be excluded by contract. Nothing in these Terms limits those rights.
- We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, for fraud, under mandatory product liability laws, and in any other case where the law does not allow liability to be limited.
- If you are a consumer, we are liable for damage caused by not performing these Terms or by performing them improperly, under the law that applies to our agreement (section 16.3). Points (d) and (e) don't apply to you.
- If you are not a consumer: except in the cases in (b), for slight negligence we are liable only if we breach an essential obligation, meaning an obligation that makes the proper use of Allomi possible in the first place and on which you can regularly rely, and only for the foreseeable damage typical for this kind of contract.
- If you are not a consumer: except in the cases in (b), our total liability for all claims connected with Allomi is limited to the amount you paid for Allomi in the 12 months before the event giving rise to the claim, or EUR 50, whichever is higher.
15. Apple App Store terms
If you got Allomi from Apple's App Store, the following also applies:
- These Terms are concluded between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for Allomi and its content.
- Your license to use Allomi is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Allomi may also be accessed by other accounts associated with you via Family Sharing or volume purchasing where these are available.
- We, not Apple, are solely responsible for providing maintenance and support for Allomi. Apple has no obligation to provide any maintenance or support services for Allomi.
- To the extent any warranty applies to Allomi and has not been effectively disclaimed, we, not Apple, are solely responsible for it. If Allomi fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Allomi, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, subject to section 14.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to Allomi or your possession and use of it, including (i) product liability claims; (ii) any claim that Allomi fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
- If a third party claims that Allomi or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Our name, address and contact details for questions, complaints and claims are in section 1.
- When using Allomi you must comply with applicable third-party terms, such as your mobile data service agreement.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
16. Complaints, disputes and governing law
16.1 Complaints
- If Allomi doesn't work as it should, or you disagree with something we did (for example, how minutes were counted or why your account was suspended), you can file a complaint. Send it by email to support@allomi.live or by post to the address in section 1.
- Please describe the problem and when it happened, say what you would like us to do, and give the email address or sign-in method linked to your account, if there is one. This helps us find your account and answer faster. Your complaint counts even if something is missing; we will ask if we need more.
- We answer every complaint within 14 days of receiving it, by email, or by post if you wrote to us by post and don't give an email address. If you are a consumer and we don't answer within 14 days, your complaint is treated as accepted.
- Payments, Apple's charges and refunds of the price are handled by Apple (section 7.6). If you write to us about them, we will tell you what to do and help where we can.
16.2 Out-of-court dispute resolution
If you are a consumer and we don't resolve your complaint, you can try to resolve the dispute out of court, provided that we both agree to it. If we reject your complaint in whole or in part, our answer will tell you whether we agree to out-of-court resolution and, if we do, which body will handle it.
- In Poland, the Office of Competition and Consumer Protection (UOKiK) lists the bodies authorised to resolve consumer disputes at polubowne.uokik.gov.pl. Consumers can also get free help from a district or municipal consumer ombudsman (powiatowy or miejski rzecznik konsumentów) and from the Trade Inspection (Inspekcja Handlowa).
- If you live in another EU country, Iceland or Norway, the European Consumer Centre in your country can help with a dispute with a trader in Poland (European Consumer Centres Network).
Using these procedures is voluntary and doesn't stop you from going to court.
16.3 Governing law and courts
- These Terms and our agreement are governed by Polish law.
- If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence.
- If you are a consumer, you can bring proceedings against us in the courts of the country where you live, or in Poland. We can bring proceedings against you only in the courts of the country where you live. In Poland, the court with jurisdiction is the one competent under the Code of Civil Procedure.
- If you are not a consumer, the Polish courts competent for our address in section 1 have jurisdiction.
17. Changes to these Terms
We may change these Terms only for one of these reasons:
- a change in the law, or a decision of a court or authority, that affects Allomi or these Terms;
- a change in Apple's rules for the App Store or for in-app purchases;
- new, changed or retired features, characters, plans or ways of using Allomi;
- a change in how we provide Allomi, such as a change of our service providers, where it affects these Terms;
- the need to prevent abuse, fraud or security threats;
- making these Terms clearer, correcting mistakes, or a change in our details in section 1.
We will publish the new version on this page and tell you about important changes in the app at least 30 days before they take effect. Changes don't apply to the past. If you don't agree, you can end the agreement before the changes take effect, by deleting your account and cancelling your subscription. A period you have already paid for is not affected (section 7.9). Changes that are only to your benefit, or that the law requires at short notice, may take effect sooner.
18. General
- These Terms, together with the Privacy Policy and, for purchases, Apple's terms, are the entire agreement between you and us about Allomi.
- If a provision of these Terms is invalid, the rest stays in force.
- If we don't enforce a right immediately, we don't give it up.
- We may transfer this agreement to someone who takes over Allomi, for example a company we set up to run it, provided your rights under it are not reduced. We will tell you in advance, and you may end the agreement if you don't agree.
- Where these Terms refer to consumers, this includes a person who runs a sole proprietorship in Poland and uses Allomi in a way that is not professional for them, to the extent that Polish law gives them consumer protection (Article 3855 of the Civil Code and Article 7aa of the Consumer Rights Act).
- These Terms are available free of charge on this page, before you start using Allomi and at any time after. You can save or print them from your browser.
- These Terms are available in the languages linked at the top of this page. If the versions differ, the English version prevails, except where the law gives priority to a version in your language. For consumers in Poland, the Polish version prevails.
